Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and DynastyTix, LLC (“DynastyTix,” “we,” “our,” or “us”), governing your access to and use of dynastytix.com, any related applications, and the services offered through them (collectively, the “Service”). By creating an account, purchasing a Dynasty Pack, or otherwise using the Service, you accept these Terms and the Pack Odds & Rules, which are incorporated by reference. If you do not agree, do not use the Service.

Please read Section 17 carefully. It contains a binding arbitration provision and a class action waiver that affect your legal rights, along with a 30-day right to opt out.

The Service is currently offered in beta. Features, matchup availability, pricing, and seat tier definitions may change as the Service develops; changes will not affect packs already purchased.

A Dynasty Pack (a “Pack”) is a purchase of two (2) tickets to the specific game you select before purchase (the “Matchup”). Every Pack contains two tickets to your selected Matchup. When you open (“rip”) a Pack, the Service reveals the seat tier and seating section allocated to your Pack. The seat tier is determined at the moment of the rip by a random allocation applying the per-Pack odds published in the Pack Odds & Rules. Each Pack’s allocation is independent of every other Pack.

Randomization determines only where you sit. It does not determine whether you receive tickets. Every Pack, at every tier, yields two tickets to the Matchup you selected. The Service does not offer gambling or wagering, no outcome results in you receiving nothing, and the Service is intended for entertainment purposes.

Seat tiers are defined by seating location as described in the Pack Odds & Rules. Seat views and images displayed on the Service are illustrative of approximate sightlines only. We make no representation or warranty regarding the market price, resale value, or face value of the tickets allocated to any Pack, at any tier, and ticket market prices fluctuate continuously. A Pack is a purchase of admission to the Matchup at the revealed seating tier, not an investment or an opportunity to profit.

You must be at least eighteen (18) years of age (or the age of majority in your state, if higher), a resident of the United States, and capable of forming a binding contract to use the Service.

The Service is not offered to, and Packs may not be purchased by, residents of, or persons located in, the State of Washington or the State of Hawaii (the “Excluded States”). We enforce this restriction using billing address, geolocation, and other verification measures, and we may cancel and refund any purchase we determine was made from or by a resident of an Excluded State. Attempting to circumvent this restriction, including through use of a VPN or false address, is a material breach of these Terms. We may modify the list of Excluded States at any time; modifications apply prospectively to new purchases only.

For clarity, the Excluded States restriction applies to the purchaser’s residence and location, not to the venue of a Matchup. Eligible purchasers may buy Packs for games played in any state.

You represent that you are not subject to U.S. sanctions and are not located in any jurisdiction subject to a comprehensive U.S. embargo.

Certain features require an account. You agree to provide accurate, current, and complete information, to maintain the security of your credentials, and to accept responsibility for activity under your account. You may maintain only one account. We may require identity, age, or address verification at any time, including before delivering tickets, and may suspend fulfillment pending verification. We may suspend or terminate accounts that we reasonably believe are duplicative, automated, fraudulent, or in violation of these Terms.

The price displayed for a Pack is the full price of that Pack, inclusive of all mandatory fees and charges, exclusive only of applicable taxes, which are itemized at checkout. Prices may vary by Matchup and may change at any time before purchase. Payments are processed by third-party payment processors, and your use of them is subject to their terms.

Because the reveal is delivered instantly and the allocation occurs at the rip, all sales are final once a Pack is ripped, except as provided in Section 8 (Postponement and Cancellation) or as required by law. Dynasty Cash applied toward a Pack purchase is restored as Dynasty Cash upon any refund; amounts paid by card are refunded to the payment method.

Initiating a chargeback with respect to a ripped Pack rather than contacting support may result in suspension of your account and, to the extent permitted by law, forfeiture of undelivered tickets and Dynasty Cash associated with the disputed transaction.

Upon ripping a Pack, the Service reveals your seat tier and seating section. Following the reveal, you have the sooner of twenty-four (24) hours from the Pack opening or twelve (12) hours before the start of the Match (the “Redemption Window”) to elect to redeem your tickets for Dynasty Cash under Section 7. If you make no election, your tickets will automatically be redeemed for Dynasty Cash. Delivery of two tickets in the revealed section, or in another section within the same seat tier as defined in the Pack Odds & Rules, will be initiated within twenty-four (24) hours after the earlier of your delivery election and the close of the Redemption Window. Tickets are delivered electronically to the email address or mobile ticketing account associated with your account, via ticket marketplaces, team or venue ticketing platforms, or other lawful delivery channels we select. You are responsible for maintaining accurate delivery information and for completing any account setup the applicable ticketing platform requires. Delivered tickets are subject to the terms of the issuing platform and the venue, including admission, conduct, and transfer policies. Risk with respect to the tickets passes to you upon our initiation of transfer to your designated delivery destination.

If tickets in the revealed section are unavailable at the time of fulfillment, we will deliver tickets in a comparable section within the same seat tier or, at our election, a higher tier. We will never deliver tickets in a lower tier than revealed.

During the Redemption Window, you may elect to surrender the tickets allocated to your Pack in exchange for a credit to your account (“Dynasty Cash”). The Dynasty Cash amount offered for your tickets will be displayed to you before you elect, and may be less than the price you paid for the Pack and less than any estimated value of the tickets. Whether to redeem is entirely your choice: you may always keep your tickets, and tickets are never converted to Dynasty Cash automatically or by default. An election to redeem, once confirmed, is final and irrevocable.

Dynasty Cash:

• may be used only to purchase Packs and other offerings on the Service, for any Matchup;
• has no cash value, is not legal tender, and is not redeemable or withdrawable for cash or any cash equivalent under any circumstances;
• is not transferable, may not be sold or exchanged, and does not accrue interest;
• is a promotional account credit, not a deposit, stored-value account, or gift certificate; and
• does not expire.

Dynasty Cash cannot be purchased directly and is issued only in redemption of tickets or as a courtesy or promotional credit we elect to provide.

If a Matchup is postponed or cancelled before your tickets or Dynasty Cash have been delivered, we will refund the full Pack price: amounts paid by payment method are refunded to that method, and Dynasty Cash applied is restored as Dynasty Cash. This refund is the exclusive remedy for pre-delivery postponement or cancellation, and any pending Redemption Window election is void.

Once your tickets have been delivered, the policies of the issuing ticketing platform and the venue govern any postponement, rescheduling, or cancellation of the Matchup, including the validity of tickets for a rescheduled date and eligibility for any refund from the issuer. We have no further obligation with respect to delivered tickets, except as required by law.

DynastyTix is not affiliated with, endorsed by, or sponsored by any sports team, league, conference, university, athletic association, or players association, including the National Football League, National Basketball Association, National Hockey League, Major League Baseball, and the National Collegiate Athletic Association, or any of their member organizations. Team names, city names, venue names, and other identifiers are used solely to identify the games for which tickets are sold. All third-party trademarks are the property of their respective owners. Tickets sold through the Service are genuine tickets obtained through lawful channels and prices may be above or below face value.

Seat tier allocation is determined by a certified random number generator. Published odds apply identically to every Pack for the applicable Matchup, each rip is independent, and no account receives odds different from those published. Current odds and tier definitions are stated in the Pack Odds & Rules, which we may update prospectively; the odds and tier definitions in effect at the time you purchase a Pack govern that Pack.

The Service, including its software, design, text, graphics, and audiovisual elements, is owned by DynastyTix or its licensors and protected by intellectual property law. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms. The DynastyTix name and logo are our trademarks. You may record and publish videos of your own rips, including monetized social content, provided you do not misrepresent your relationship with DynastyTix or the nature of any promotional consideration you receive, and you comply with applicable endorsement disclosure requirements.

You agree not to: use the Service in violation of law; use bots, scripts, or automated means to purchase or rip Packs; create multiple accounts or misrepresent your identity, age, location, or state of residence; circumvent or attempt to circumvent the Excluded States restriction or any geographic or eligibility control; buy, sell, or transfer accounts or Dynasty Cash; resell Packs (as distinct from delivered tickets, which are yours); interfere with the operation or security of the Service; reverse engineer the Service; or use the Service to infringe the rights of any third party.

The integrity of the allocation process is fundamental to the Service. If we determine, acting reasonably and on the basis of evidence, that any Pack was purchased or ripped, or any allocation, ticket, or Dynasty Cash was obtained, through unauthorized access to or interference with the Service; manipulation or attempted manipulation or prediction of the allocation mechanism; exploitation of a bug, error, or vulnerability (including continuing to transact after a malfunction that a reasonable user would recognize as such); use of automated tools; collusion among accounts; use of multiple, false, or compromised accounts; or any other scheme to obtain outcomes, credit, or inventory not intended to be available (each, an “Exploit”), then, notwithstanding anything else in these Terms, we may: void the affected rips and allocations; cancel undelivered tickets and reverse Dynasty Cash attributable to the Exploit, including amounts already spent, by adjusting account balances; suspend or terminate the accounts involved; and pursue recovery of amounts paid out and any other available remedies. Where we void a rip, we will refund the Pack price actually paid in cash for that Pack, unless the payment itself was fraudulent. Rips, tickets, and Dynasty Cash not attributable to an Exploit are unaffected by this section. In addition, if a Pack price, odds figure, tier definition, or Dynasty Cash amount is published or displayed in error and the error is one a reasonable user would recognize as such, we may cancel affected transactions and refund amounts paid; published corrections apply prospectively. We may investigate suspected Exploits, preserve and review related records consistent with our Privacy Policy, and report unlawful conduct, including unauthorized access to computer systems, to law enforcement. Nothing in this section limits remedies available to us at law or in equity.

We may offer promotions, referral rewards, or free Packs from time to time. Any such offering is subject to the rules stated for it, may be modified or discontinued at any time, and, where structured as a sweepstakes, will include a free method of entry and official rules that govern over these Terms for that promotion.

You may close your account at any time. We may suspend or terminate your access for violation of these Terms, suspected fraud, or as required by law. Termination does not extinguish your right to delivery of tickets allocated to Packs already ripped, except where the Pack was purchased or ripped through fraud or material breach (including breach of Section 3), and does not extinguish obligations that accrued before termination. Sections that by their nature should survive termination survive.

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranty that the Service will be uninterrupted or error-free. Without limiting Section 2, we make no warranty regarding the market price, resale value, or face value of any tickets. Some jurisdictions do not allow certain disclaimers, so some of the foregoing may not apply to you.

To the maximum extent permitted by law, DynastyTix and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to the Service. Our aggregate liability for all claims arising out of or related to the Service will not exceed the greater of (a) the amounts you paid to us in the twelve (12) months preceding the event giving rise to the claim and (b) one hundred dollars ($100). In the event of a dispute, under no circumstances will any party be entitled to recover consequential damages, special damages, or attorney’s fees. These limitations do not apply to liability that cannot be limited by law, or to our obligation to deliver tickets allocated to a ripped Pack or to pay a refund due under Section 8.

Before filing any claim, you agree to first contact us at legal@dynastytix.com with a description of the dispute and give us sixty (60) days to resolve it informally.

Except for (a) individual claims properly brought in small claims court and (b) claims for injunctive relief concerning intellectual property, any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The Federal Arbitration Act governs this section. The arbitration will be conducted in English, remotely or, if in person, in Palm Beach County, Florida or another mutually agreed location. Judgment on the award may be entered in any court of competent jurisdiction.

You and DynastyTix each waive the right to a jury trial and to participate in a class, collective, or representative action.

If twenty-five (25) or more similar demands are filed by or with the assistance of the same or coordinated counsel, the parties agree to the AAA Mass Arbitration Supplementary Rules, including batching or bellwether procedures as the AAA directs.

You may opt out of this arbitration agreement by sending written notice to legal@dynastytix.com within thirty (30) days of first accepting these Terms, stating your name, account email, and intent to opt out. Opting out does not affect any other provision of these Terms.

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles, except that the Federal Arbitration Act governs Section 17. Any claim not subject to arbitration will be brought exclusively in the state courts located in Palm Beach County, Florida, and the parties consent to personal jurisdiction there.

We may revise these Terms from time to time. For material changes, we will provide notice by email or prominent notice on the Service at least 7 days before the change takes effect, and the revised Terms will apply prospectively. Material changes to Section 17 will not apply to disputes that arose before the change. Your continued use of the Service after the effective date constitutes acceptance.

These Terms, together with the Privacy Policy and the Pack Odds & Rules, are the entire agreement between you and DynastyTix regarding the Service. If any provision is held unenforceable, it will be limited to the minimum extent necessary and the remainder will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Notices to you may be provided by email to your account address or by posting on the Service.
